Coimbatore: In a significant legal battle, Champion Textiles Ltd. has emerged victorious against JMJ Housing Ltd. and its director, winning an arbitration award of Rs. 7.75 crore. This ruling, issued by former Madras High Court Justice T. Ravindran, pertains to a dispute concerning a residential development project in Pattanam village, Coimbatore, as per the award dated October 12, 2026.
In January 2022, Champion Textiles, led by Managing Director V.R.S. Natarajan, entered into a Joint Development Agreement (JDA) with JMJ Housing, represented by its director Wilson P. Thomas. The agreement outlined the terms for a residential development project, entailing shared benefits and responsibilities between the parties.
However, disagreements quickly arose over the execution of the project. Champion Textiles alleged that JMJ Housing had transferred certain plots to third parties, violating their agreement and General Power of Attorney. The company further claimed that no composite agreements existed with prospective buyers prior to registering these property transactions.
The developers countered these claims, asserting they had invested significantly in preliminary work for the project. They contended that their actions complied with the terms of the JDA.
After scrutinizing the presented evidence and testimonies, the arbitrator ruled in favor of Champion Textiles, finding substantial breaches in the agreement by JMJ Housing. The tribunal’s findings confirmed the developer’s failure to adhere to their contractual obligations regarding property transfers and sale deeds.
As part of the award, the tribunal mandated JMJ Housing and its director to pay Rs. 6.75 crore to Champion Textiles, along with an 18% annual interest from March 13, 2025, until full settlement. An additional amount of Rs. 1 crore also carries the same interest rate from the date of the award.
Overall, the financial compensation amounts to Rs. 7.75 crore, excluding interest and associated legal costs incurred during the arbitration process. Moreover, the ruling entails the cancellation of ten specific sale deeds associated with the disputed property, undermining previous transactions made outside the terms of the JDA.
The award further obliges the respondents to deliver vacant possession of the property listed in Schedule A of the award to Champion Textiles within one month of the ruling.
The arbitration proceedings highlighted the complex nature of contractual obligations and development responsibilities. Champion Textiles sought clarity on property rights and monetary compensation, while JMJ Housing contested the allegations, aiming for dismissal of the claims.
As this case unfolds, the implications of the tribunal’s findings on future real estate transactions and contractual agreements in the Coimbatore region remain to be observed. The legal status of the award and its subsequent enforcement are separate issues yet to be discussed.
